Texas Tribune, Alex Nguyen, Sunday 2:57 p.m. Central / Time, Chad de Guzman: a U.S. Immigration and Customs Enforcement agent shot a man in North Austin Sunday afternoon near Anderson Square and Research Boulevard. Sheridan Nolen, Texas Department of Public Safety: troopers got a call about 12:50 p.m. from ICE asking help to pursue a blue Toyota Corolla. Before they arrived, an ICE agent had shot a man. Troopers treated the driver. Austin-Travis County EMS chief Rob Luckritz: notified about 12:56 p.m. CT. Gunshot to the torso. Austin Police Chief Lisa Davis: preliminary information pointed to a “small foot pursuit.” The man went to Dell Seton Medical Center in stable condition.
Kate Lincoln-Goldfinch, an Austin immigration lawyer who said she was hired to represent the man and his wife, identified him as Wilber Rafael Garces Perez, 28, of Venezuela. Tribune, citing her: he had a work permit, entered the United States legally, and was delivering for DoorDash. A lawyer’s account is not a court finding. DHS, without naming him: the Venezuelan who was shot “illegally entered our country under the Biden Administration” and had a final order of removal; he is stable and “in federal custody pending removal.” Two sentences. We will not pick a winner. Lincoln-Goldfinch said his wife was turned away at the hospital and learned hours later he was already in ICE custody.
HSI, with the FBI, is leading the federal investigation, DHS said. Mayor Kirk Watson: local police were not involved; he called for a probe that is “clear-eyed.” Travis County District Attorney: it is possible the incident included violations of state law. That is a request, not a charge. The ICE agent has not been publicly identified. Watson: “We do not know” the agent’s whereabouts. We will not invent a name or a booking. Rep. Greg Casar asked for body-camera footage and said, if ICE deports him, “the key witness to their shooting disappears.” A letter is not a hold.
