Reuters, Sept. 12: U.S. District Judge Susan Illston in San Francisco, in a decision issued late Friday, ruled the Trump administration broke the law by ordering FEMA to cut its workforce in half. DHS, she wrote, usurped FEMAโs authority over its own personnel and steered the agency to cut thousands of disaster-response jobs.
A federal law adopted after Hurricane Katrina in 2005 says DHS โmay not substantially or significantly reduceโ FEMAโs authorities, responsibilities, or functions. Illston: the department violated that when it moved last year to stop FEMA from renewing temporary contracts of thousands of on-call reservists. โThere is no evidence in the record reflecting reasoned decision-making for this about-face.โ
FEMA projected 11,383 employees for the coming fiscal year โ approximately half of prior levels โ โwithout any basis for choosing that number,โ she wrote. Fridayโs ruling did not include remedies or penalties. Those come in a separate ruling next month. Unions may brief the scope of relief. AFGE is a plaintiff. FEMA, DHS, and AFGE did not immediately comment Saturday.
In a separate decision she faulted officials for using Signal on personal phones and deleting messages about the cuts. Going forward she would presume the lost messages โwould have been unfavorable to Defendants.โ Reporting by Daniel Wiessner.
