WTOP / CNN, Monday 11:54 p.m. ET: Attorneys for CNN, MS NOW, and Politico asked U.S. District Judge Tim Kelly late Monday to extend the order that temporarily restored their White House access. The outlets asked for a preliminary injunction that would keep the badges on while the case is pending. They called the ban an “unlawful assault on the most fundamental First Amendment freedoms.” Kelly’s temporary restraining order expires Oct. 8. The Trump administration is listed to respond by Friday. The outlets are listed to file a final brief by next Monday. Kelly said he intends to rule “expeditiously.” That is a docket, not a ruling we have.
The new papers also cited Saturday’s unused plane: the White House left CNN off Air Force One for Knoxville even after hard passes were restored. That seat swap already ran. We will not reprint it as first-day news, and we will not type Kelly granting a longer order this board does not have. A filing is not the injunction.
