The committee listed the session for 9:00 a.m. in Hart 216. In his opening, Smith said, “I stand by my decisions as special counsel, including my decision to bring charges against President Trump. I made these decisions without regard to President Trump’s political association, activities, beliefs, or candidacy in the 2024 presidential election.” He added: if asked whether to prosecute a former president on the same facts today, “I would do so regardless of whether that President was a Republican or a Democrat.” That is his line. It is testimony, not a jury.
Same ABC file: Chairman Chuck Grassley, R-Iowa, called Smith’s operation “a partisan weapon that broke the rules.” Ranking Member Dick Durbin, D-Ill., called Republican attacks “a smokescreen.” Smith told Grassley his office did acquire financial information; he said the subpoenas were to investigate “one of the most serious crimes that has ever happened in our nation's history.” After Grassley named colleagues, Smith called their firings “an outrage.” Sen. Eric Schmitt, R-Mo., pressed a Feb. 3, 2024, basketball date; Smith said he had “no recollection” of an Atlanta Hawks game and told Sen. Amy Klobuchar, D-Minn., the texts were Iowa Hawkeyes, not Atlanta. ABC: neither Trump case reached a jury after 2024; Smith moved to dismiss both under DOJ policy against prosecuting a sitting president. Attorney General Todd Blanche said in July the department was investigating a criminal referral. Smith’s attorneys called that referral “spurious.” A referral is not an indictment we have.
