Department of Justice, Tuesday, Sept. 15 / WSB-TV, Thursday 1:10 p.m. ET: a superseding indictment unsealed in the Southern District of Georgia charges five defendants with exploiting the H-2A nonimmigrant visa program โ temporary farm labor when growers cannot find enough domestic workers โ to fraudulently obtain visas and smuggle people into the United States. An indictment is an allegation. All five are presumed innocent.
Named: Martha Aquino, also Martha Patricia Resendez Sanchez or โMarta,โ 61; Evangelina Aquino De Galvan, 49; Julio Cervantes, 38, all of Alma, Georgia; Marco Cervantes, also โChiquilin,โ 41, of Rowlett, Georgia; Juan Felipe Romero-Lopez, 31, a Mexican national the government calls unlawfully present. Prosecutors: they lied about where workers would work and live, demanded improper payments before visas or work, confiscated passports and other ID, and at times threatened or used violence to keep workers from leaving. After visas expired, they allegedly helped workers stay and offered to move them elsewhere for more money.
Aquino, Julio Cervantes, and Marco Cervantes were arrested this week. Aquino De Galvan remains at large. Romero-Lopez was already detained after a May 2026 charge of unlawful firearm possession by an illegal alien. WSB: Monday warrants in Bacon County with HSI, Georgia State Patrol SWAT, and local deputies. Three in custody this week is not five in custody.
If convicted: all five face a maximum five years on visa-fraud conspiracy. Aquino, Aquino De Galvan, Julio, and Marco each face 10 years on visa fraud. Aquino, Aquino De Galvan, and Julio each face 10 years for encouraging and inducing illegal entry for commercial advantage. Romero-Lopez faces 15 years on the firearm count. Ceilings are not sentences. Kramer already ran. San Diegoโs 12 already ran. The Russian-intel five already ran. This unused file is Georgiaโs five.
Assistant Attorney General A. Tysen Duva: instead of helping American farmers, these defendants allegedly concocted a scheme to enrich themselves. U.S. Attorney Margaret E. โMegโ Heap: exploiters of immigrant workers and the H-2A program will be held accountable. HSI, State Department Diplomatic Security, Labor OIG, and the Georgia Bureau of Investigation are on the case. Joint Task Force Alpha supported the prosecution.
What this means for you
