Friday’s Nov. 3 clock already ran. This is Saturday’s unused petition.
Reuters, Andrew Chung, Friday 8:58 p.m. ET via USA Today: President Trump asked the U.S. Supreme Court on Oct. 9 to revive a dismissed lawsuit against Hillary Clinton, former FBI Director James Comey, former British intelligence officer Christopher Steele, the Democratic National Committee, and others. He filed the case in 2022 in federal court in Florida, alleging a conspiracy to discredit his 2016 campaign with a “false narrative” of Russia collusion. A petition is not a grant. The Court has not said it will hear the case.
Same Reuters file: U.S. District Judge Donald Middlebrooks dismissed the suit, saying some claims were filed too late and likening the complaint to a “two-hundred-page political manifesto.” He later ordered Trump and lead attorney Alina Habba to pay nearly $1 million in fees and costs, finding the case was meant “to dishonestly advance a political narrative.” The 11th U.S. Circuit Court of Appeals in Atlanta upheld the dismissal and the sanctions in 2025. The panel, which included Trump appointee Andrew Brasher, wrote that “many of Trump’s and Habba’s legal arguments were indeed frivolous.” Sanctions still standing below are not a Supreme Court win.
The Oct. 9 brief: lawyers for Trump and Habba wrote that review is “necessary to protect the presidency” and that the time limit should have been extended because he deferred suing during his first term. That is their argument. It is not a ruling. Friday already filed no attack before Nov. 3. We will not reprint that pledge as first-day news.
What this means for you
If you needed Friday’s unused politics, it still stands as no strike before Nov. 3, blockade on. If you needed this morning’s unused sentence, it is an appeal filed, dismissal and ~$1 million sanctions still below. If you needed the Court to take the case, this post does not hand that over.
Bottom line: He asked. The Court has not granted. Sanctions still stand below. Not Nov. 3 reprinted.
