Reuters, Luc Cohen, Sept. 14: A second federal judge late Sunday moved to block the Trump administration from implementing a new U.S. Postal Service rule that would tighten mail-in voting requirements. Washington U.S. District Judge Carl Nichols โ appointed by Trump in his first term โ granted the Democratic Party a preliminary injunction. Quote: โNo statute grants the Postal Service the power to issue key parts of the rule.โ The party called the rule an unlawful federal intrusion into election administration.
The Supreme Court is still weighing the administrationโs request to overturn a separate order blocking the same rule. The Nov. 3 midterms remain the calendar. The rule followed Executive Order 14,399 and a final Postal Service rule published Aug. 21. Nicholsโ order is a preliminary injunction. It is not a Supreme Court opinion and not a statute rewrite.
What this means for you
If you needed Air Force One, that was 8 a.m. If you vote by mail in November, two judges have now paused this rule. The Court has not closed the file.
Bottom line: Second judge. No statute, Nichols wrote. Not SCOTUS. Not Nov. 3 yet.
