Reuters, Nate Raymond, Sept. 14: dozens of Democratic-led states, counties, and cities sued the Trump administration Monday to block a Department of Homeland Security rule that would let officers deny green cards to people who use public benefits such as food stamps and Medicaid. Two complaints in Manhattan federal court. The rule is set to take effect Friday.
New York, California, and Illinois lead 22 states plus the District of Columbia. A second suit: New York City, Chicago, San Francisco, and Seattle, among six cities and counties. The rule, announced in July, revives a 2019 first-term test that the Biden administration narrowed in 2022. Under the Biden-era rule, officers could weigh SSI and cash aid, not non-cash benefits. Those non-cash benefits count again.
New York Attorney General Letitia James: “This rule preys on that fear and counts on families forfeiting the food assistance, healthcare coverage and other public benefits to which they are legally entitled.” New York City Mayor Zohran Mamdani said the rule “seeks to push immigrant families away from the programs that have kept people fed and healthy for decades.” A DHS spokesperson called the plaintiffs “sanctuary states” and said they were “terrified they will lose federal funds.”
The suits argue the rule exceeds DHS’s authority under the Administrative Procedure Act. Similar cases beat the 2019 version. A complaint is not a preliminary injunction. Friday is still on the calendar unless a judge moves it.
